Back in 2017, on or around the month of August, Diana Schmus and Vic Graves came up with the idea to make a flogger out of rubber bands whilst making rubber band bracelets. Five years later we are still making them, and through feedback of people we have either given them to or charged a nominal fee for, and through several somewhat extensive searches, we have determined that we are the only ones in the world that make them. We therefore claim copyright on the design and construction of said floggers. We do not claim copyright on the weaving technique that makes each flogger fall, but we do claim copyright on the following:
- The number of bands used in the weave and in each fall.
- The attachment method to put them on a handle.
- The general idea and design of making these woven bands into floggers.
- The name “Tentacle Flogger”.

To the best of our knowledge, and by some fairly extensive research, we have determined that we are the only ones in the world to make this kind of flogger design. Attempting to copy and sell this this kind of flogger will result in a cease and desist request which may be followed by legal actions.
